1. European Convention on Human Rights

Law & Legal · Court Abbreviations · also used in organizations

Council of Europe treaty, signed in Rome in 1950 and in force since 1953, protecting rights such as life, liberty, fair trial, private life, expression and freedom from torture. All 46 Council of Europe member states are parties, and the European Court of Human Rights enforces it.

Example: The claimant argued that the bulk surveillance law violated Article 8 of the ECHR.

In the United Kingdom, the Human Rights Act 1998 makes most Convention rights enforceable in domestic courts. Many writers also use ECHR for the Strasbourg court; academic usage reserves ECtHR for the court. The Convention is distinct from the EU Charter of Fundamental Rights.

2. European Court of Human Rights

Organizations & Companies · International Organization Abbreviations

International court in Strasbourg that rules on alleged violations of the European Convention on Human Rights by the 46 member states of the Council of Europe. Individuals can bring cases after exhausting remedies in national courts.

Example: The ECHR found that the prisoner's treatment violated the ban on degrading treatment.

Set up in 1959, it is properly abbreviated ECtHR, to distinguish it from the convention it applies. It is not an EU institution and is separate from the EU's Court of Justice in Luxembourg. Its judgments are binding on the states concerned, and the Council of Europe's Committee of Ministers supervises their execution.
