Usage notes
The 1938 law followed the Elixir Sulfanilamide disaster, in which an untested drug made with a toxic solvent killed more than 100 people. The 1962 Kefauver-Harris Amendments, prompted by thalidomide, added proof of effectiveness. It is also written "FD&C Act", the source of color additive names such as FD&C Red No. 40.
