USERRA stands for Uniformed Services Employment and Reemployment Rights Act, a US law abbreviation also used in the military.
Law of 1994 that protects civilian jobs of people who leave to serve in the military, including the National Guard and reserves. Returning service members must be rehired in the position they would have reached had they not left, with seniority and benefits.
Example: The reservist's employer must reinstate him under USERRA after his deployment.
Usage notes
Protection generally applies to cumulative absences of up to five years with one employer. The "escalator principle" means returning workers step back on the job ladder at the level they would have reached. The Labor Department's Veterans' Employment and Training Service investigates complaints. It covers employers of all sizes.
